1. Who we are

This site is operated by YAJ Services LLC, a Michigan limited liability company trading under the registered assumed name YAJ Jet Charter, of Fenton, Michigan. References to “we”, “us”, and “YAJ” mean that company.

2. What we are, and what we are not

YAJ Jet Charter is an air charter broker within the meaning of 14 CFR Part 295. We are not a direct air carrier or a direct foreign air carrier. We do not hold an air carrier certificate, and we do not own, operate, crew, dispatch, or hold operational control of any aircraft.

Every flight we arrange is performed by a direct air carrier that holds the economic authority required by the U.S. Department of Transportation and the safety authority required by the Federal Aviation Administration. That carrier holds operational control and is solely responsible for the aircraft, the crew, and the conduct and safety of the flight.

3. Quotes are not bookings

Prices, aircraft, and availability shown on this site or given in conversation are indicative only. Nothing is arranged, confirmed, or held until we have a binding commitment from an operating carrier and you have signed the trip agreement. We will not describe an aircraft, flight, or departure time as confirmed before that point.

Aircraft categories, seat counts, and range figures shown on this site are typical for the class. Actual performance varies with aircraft, load, weather, and runway.

4. Disclosures we make before you contract

Before you enter into a contract for any flight we will disclose, without being asked, the corporate name of the operating carrier together with any other names it holds itself out under, the capacity in which we are acting, and whether we hold liability insurance covering you and your passengers along with its limits.

We act as agent of the charterer on every trip. We are not an indirect air carrier and do not purchase air transportation for our own account to resell.

On request we will also disclose any business relationship between us and the operating carrier that may bear on our selection of it, the total cost of the transportation including fees and taxes, and an estimate of amounts payable by you directly to third parties. In practice we provide all of these whether or not you ask.

If any of that information is unknown when you contract, or changes afterwards, we will tell you within a reasonable time and in any event before the flight begins. If we are late in telling you, you may cancel and receive a full refund of monies paid for the transportation.

5. Fees

Our advisory fee is five percent of the operating carrier’s charter price, subject to a minimum of $750 per trip. The fee is shown as a separate line and is never embedded in the carrier’s price. We accept no commission, rebate, referral payment, or other consideration from any carrier in connection with a flight we arrange for you. If any such payment were ever received, we would disclose it and credit its full value against our fee.

We act as your agent. With your authorisation we contract with the operating carrier on your behalf, collect the amount due, and remit the carrier’s portion to them. Our fee is itemised separately and is never folded into the carrier’s price.

Where a refund is due of any amount paid to us, we make it promptly: for credit card payments in accordance with 14 CFR § 374.3 and 12 CFR Part 226, and for cash and cheque payments within 20 days of a complete refund request.

6. Insurance

The operating carrier holds the liability insurance covering passengers, baggage, and the aircraft, and we provide its limits to you in writing before you sign anything. YAJ Jet Charter does not itself hold liability insurance covering charterers, passengers, or their property on a flight. Any insurance we carry protects our own advisory services and does not insure you or your passengers against loss, injury, or damage arising from the operation of a flight.

7. Delays, cancellations, and aircraft changes

Schedule changes, delays, diversions, cancellations, and aircraft substitutions are decisions of the operating carrier, made under its own charter agreement with you and, where relevant, in the interests of safety. We will pass on information as soon as we have it and will source alternatives where we can, but we are not liable for the acts or omissions of a carrier.

Where a flight is a repositioning or empty leg, it is subject to the trip that created it. We will tell you when a quote is of that kind and what it means for your travel.

8. Your responsibilities

You are responsible for giving us accurate passenger names, weights, dates of birth, and travel document details, for the conduct of everyone travelling under your booking, and for disclosing in advance anything restricted that you intend to carry. You confirm that neither you nor any passenger is a person with whom dealings are prohibited under U.S. sanctions or export control laws.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability to you arising out of or in connection with the services is limited to the amount of the advisory fee paid for the trip in question, and we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profit, lost opportunity, missed meetings, or the cost of alternative travel.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded, including liability for fraud, gross negligence, or willful misconduct, and nothing limits any right conferred on you by 14 CFR Part 295.

11. Nothing here waives regulatory obligations

These terms govern the relationship between you and YAJ Services LLC. They do not waive, and cannot waive, any obligation we owe to the U.S. Department of Transportation under 14 CFR Part 295, or any right that Part confers on you.

12. Governing law

These terms are governed by the laws of the State of Michigan, without regard to conflict of laws principles. The courts sitting in Genesee County, Michigan have jurisdiction over any dispute arising from them.
